1. Intent
These General Contest Rules (the “Rules”) apply to all contests administered by Mix 98.5 FM (the “Radio Station”). Unless specific rules are stated for an individual contest, these Rules govern all participation. By entering a contest, entrants agree to be legally bound by these Rules and confirm they have read and understood them.
2. Eligibility
Unless otherwise stated, contests are open to legal residents of Ontario aged 18 or older. Employees of Mix 98.5 FM, its parent company, affiliates, sponsors, and advertising partners — along with anyone living in the same household or immediate family (parents, siblings, children, or spouses) — are not eligible to participate.
3. Contest Entry
No purchase is required. Entries may be submitted via online forms, email, phone, or social media, as described in each contest’s specific rules. Unless stated otherwise, only one entry per person per day is allowed. For contests on social media, participants must have a valid account and follow the platform’s terms of use.
4. Prize Details and Claims
Prizes may include cash, gift cards, merchandise, event tickets, or other promotional items. Prizes are non-transferable, non-exchangeable, have no cash value, and must be accepted as awarded. Mix 98.5 FM may substitute a prize of equal or greater value if necessary. Winners must provide valid government-issued photo ID to claim prizes, which must be claimed within 30 days unless otherwise specified. Unclaimed prizes may be forfeited.
5. Winner Selection and Notification
Winners are chosen at random unless stated otherwise. Mix 98.5 FM will attempt to contact winners using the information provided. If there is no response within 7 days, the prize may be forfeited and another winner selected. The Radio Station is not responsible for outdated or incorrect contact information.
6. Use of Personal Information
By entering, participants consent to the collection and use of their personal information (name, email, phone number, etc.) for contest administration and prize fulfillment. This information may be shared with sponsors. Winners also grant Mix 98.5 FM permission to use their name, photo, city, voice, and statements for promotional purposes without additional compensation.
7. Disclaimers and Limitations
Mix 98.5 FM is not liable for technical failures, delays, or disruptions due to circumstances beyond its control (e.g., acts of God, pandemics, or internet outages). The Radio Station is also not responsible for any damage, loss, or injury related to contest participation or prize use. Contests may be modified or cancelled without notice.
8. Internet and Technical Issues
Technical issues such as connectivity or streaming delays may affect entry or notification. Mix 98.5 FM is not responsible for lost or misdirected entries due to such errors.
9. Publicity and Promotional Use
By entering, participants agree that Mix 98.5 FM may use their name, likeness, voice, and submitted content in any media for promotional purposes. Winners may be required to sign a release form confirming these rights before receiving a prize.
10. General Conditions
All decisions made by Mix 98.5 FM are final. The Radio Station may disqualify anyone who violates the Rules or disrupts the contest process. These contests are governed by Ontario law and any disputes must be resolved in Ontario courts.
11. Amendments
Mix 98.5 FM may update these Rules at any time without notice. Changes take effect immediately upon posting on the station’s website.
